Disney Pool Home 4U Booking Terms and Conditions Responsibility of Party Leader The Party leader accepts full responsibility for the condition and contents of the rental property during the stay there with other party members ("The Party") and shall inform the other party members of the terms and conditions which apply to all members of the" party". Party Restrictions Everyone occupying the property must be listed on the guest registration form, including small children. This is Florida state law and must be adhered to. The accommodations cannot be shared or sub-let and only the persons shown on the booking form are permitted to stay in the property. Persons under 25 years of age cannot stay in the villas unless accompanied by responsible adults over the age of 25 Failure to comply will render the booking void and no compensation will be paid. If, following the submission of the original booking, changes to the composition of your party arises, these changes should be immediately advised to us. Under NO CIRCUMSTANCES can the size of the party exceed the maximum occupancy which is shown below. Damage or Loss caused! The Party shall be jointly and severally liable for any damage or loss of any kind caused to the rental property or its contents. (See also security deposit information below) Security of personal property The party is solely responsible for, and shall secure, all their personal property in the rental property. The property owner, manager, or Tour operator/agent shall not be responsible for any lost or stolen items. Where a security alarm is fitted to the property, it should be properly set when the property is not in occupation. Security and Booking Deposit We require a $200 booking deposit at the time of the reservation. We will require a refundable SECURITY DEPOSIT of $400 to be paid 8 weeks prior to the booking along with the balance due for the rental. This deposit will be repaid to the lead named person on the booking form within 3 weeks of departure from the villa providing there have been no reported breakages or damage, and your party has returned the keys to the designated place. The submission of the booking form confirms your acceptance to pay for any damage of any kind caused by you or your party’s occupancy of the property and the lead named person on the booking form agrees to be held responsible for any additional costs which exceed the security deposit. The Party leader and the whole party agrees to hold harmless and indemnify the property owner, manager or tour operator/agent for any loss, claims, costs, expenses, or actions arising from the party's use and occupancy of the rental property and pool. Failure to make full payment of rents within 24 hours Full payment of the balance of rent together with any additional services booked, the tax due thereon and the relevant security deposit is due for payment at the latest 8 weeks before your due arrival date. Failure to make this payment in full will authorize us to cancel your booking. You will forfeit any rental deposit already made to us and the villa will be re-opened up for rental. Swimming Pool There is no lifeguard on duty and it is a major condition of the reservation that use of the rental property and pool is entirely at the risk of the renter. The pool has a maximum depth of 6 feet. All diving, horseplay or running around the pool area is prohibited. All members of the party agree that no child in the party, or adult non-swimmer, will use the pool without adequate adult supervision by a strong swimmer. Any problems which may be experienced with pool alarms installed on the exterior doors leading to the pool area should be notified immediately. Alternatively, where a pool safety fence is installed, this is removed at the risk of the party and should remain secured fully in place when non swimmers are in residence or visiting the property. Ancillary services If the owner or manager fails to provide any ancillary service (e.g. Pool heating, crib, high chair, BBQ or like items), the party's sole remedy shall be to receive a refund of the additional fees charged for any such item. In the event that solar heating is provided at no charge by the property owner or agent, as no payment is made for the service no compensation will be payable in the event that it is either not available or alternatively due to weather conditions, unable to heat the pool to an acceptable temperature. In no event, shall the aggregate liability of the owner, manager, Tour operator/agent exceed the actual monies paid by the party for use of the rental property, less any applicable taxes. Pool heating Pool heating must be booked in advance of arrival to be guaranteed. There is a supplemental charge of $100 per week or $25 per day for this ancillary service. Our home comes with solar heating for no additional charge. During the winter months however, we do recommend that additional electric pool heating should be booked. During the winter months, the electric heater will generally heat the pool to around 85 degrees Fahrenheit. If the air temperature, however lowers to 55 degrees or less, then although the heaters operate for longer hours than in warmer weather they will not be very effective and the water temperature will not reach a comfortable level. We regret that in these circumstances a refund of part or all of the supplement paid is not possible and your understanding of this important matter is an essential part of this reservation. No Smoking Our home is non-smoking property and smoking is not permitted under any circumstances within the property. Where it is discovered that smoking is taking place within the property, this will be regarded as a material breach of our terms and conditions and the short term tenancy will be cancelled immediately without compensation No Pets No pets are permitted in our home and if it is discovered that a pet has been in the home, there is an automatic charge of $100 to cover the cost of professionally cleaning all carpets and upholstery. There is an additional charge should a pest control company's services be required. Accidents or illness The party understands and agrees that neither the property owner, manager, or tour operator/agent can accept any responsibility whatsoever in case of accident or illness while on the property. Disputes Any disputes under this agreement shall be resolved exclusively via binding arbitration according to the rules of the American Arbitration Association for commercial disputes in Osceola County, Florida, applying Florida law. Each party shall pay their own attorney's fees/costs, and, the State of Florida shall have exclusive personal and in "rem" jurisdiction over any dispute. Maximum Occupancy The party should note that Florida law puts strict limits on the number of occupants permitted to stay overnight in vacation homes. We the Owners of this vacation home have set a lower maximum occupancy level than that permitted by law. Legal maximum occupancy for our 4 bedroom home is 8 persons. Under NO CIRCUMSTANCES can the size of the party exceed the maximum occupancy figure shown above. In the event of higher occupancy than that permitted you will be required to vacate the property. In this event there can be no refund of the rental payment. Cancellation of Reservations If you cancel your reservation of a vacation home, up to 8 weeks prior to your arrival date you will forfeit any booking deposit already paid to us. If you cancel your reservation within 8 weeks of your due arrival date or you fail to show up then you will forfeit any booking deposit and rents already paid to us. NO REFUNDS will be given for cancellations within 8 weeks of arrival or no shows. We strongly suggest that you take out the necessary travel insurance to cover your costs in case you are unable to travel for any reason. No Shows! Your Guarantee and Limits to our liability Our whole aim is to ensure your vacation is magical and we will work hard to ensure that your vacation property is presented to you perfectly. However things can go wrong and we ask that you draw to our attention immediately should you discover anything missing or broken. This enables us to put them right and/or replace as quickly as possible.

$200 Deposit require at booking. Balance of rent due, 13% Florida Taxes and $250 refundable damage deposit due 8 weeks prior to arrival along with any addition costs, i.e. $100/week electric pool heat. .

Booking deposit refunded only if booking is cancelled 60 or more days before arrival. Booking deposit, rental money and other costs MAY be returned within 60 days of arrival if property can be re-booked for that same rental period. Damage deposit returned if property is in same condition it was found within 3 weeks after departure
